In a January 30, 2004 letter to Chief Justice Rehnquist, Reps. Waxman and Conyers requested an “exam[ination] of the merits of establishing a procedure for formal review of recusal decisions by Supreme Court Justices.” This letter is a follow-up to a January 22, 2004 letter sent to Chief Justice Rehnquist by Senators Leahy and Lieberman “inquir[ing] what canons, procedures and rules are in place for Supreme Court justices to determine whether they must or should recuse themselves…” Chief Justice Rehnquist’s reply to this letter is here.
