ABA:
- “The proposed Algorithmic Accountability Act of 2022, H.R. 6580, 117th Cong. (2022), requires companies to implement assessments of their algorithmic decision tools to detect issues with privacy and discrimination among others.
- The Act would be enforced by the FTC, which may not have jurisdiction over some companies, such as non-profits and companies in the business of insurance.
- Potential gaps in coverage may create unequal treatment of companies in the same sector with potential impacts on the ability of the Act to achieve its stated goals, as well as on competition and innovation.
- Many entities in the healthcare industry, such as nonprofit or government-owned hospitals and health insurance companies may not be covered, which could impact competition and innovation in this sector.”
